An interesting trademark application "Airbnboat" was filed in Portugal with Class 43 by an individual recently. Regardless of the figurative mark filed, what appears in my mind is "Airbnb". 從Airbnb的業務來看，主要是提供臨時住宿出租之業務。加上"boat"字大膽猜想的話，估計商標申請“Airbnboat”提供的服務是提供臨時船隻出租之業務。再看看第43類的商品或服務類別，其主要包括由個人或機構提供的服務，其目的是準備消費食品和飲料，以及為在旅館、寄宿處或其他提供臨時住宿的機構中獲得住宿和膳食而提供的服務。

"Airbnb" is a well-known trademark with a high degree of identification. The above trademark application "Airbnboat" ("Airbnboat" hereafter)is highly similar to "Airbnb" with similar goods or services designated for usage. Objectively, it should cause relevant businesses or consumers to misunderstand "Airbnboat". If the goods or services come from the same source, there is a risk of likelihood of confusion or misidentification. Therefore the trademark application "Airbnboat" violates the provisions of the Industrial Property Code 2018, Decree-law no 110/2018, 10 December, and high possibility of being rejected.
